Terms of Service
1. Scope and Acceptance
These Terms of Service govern the use of the TrustCamera website, web application, and native mobile app, operated by TrustCamera. By using the service, you accept these terms in full. Use is entirely at your own risk.
2. Exclusion of Liability
By using the website and web application, we exclude all claims for recourse due to damage, loss, or other events. TrustCamera, its representatives, and affiliates assume no liability whatsoever for any direct, indirect, incidental, consequential, or special damages arising from the use of the service. This applies regardless of the legal basis.
3. Misuse and Fraud
TrustCamera assumes no liability if third parties manage to cause financial damage through deception, fraud, or similar actions using our service. The service is a tool for photo verification and does not replace the user's own due diligence.
4. Storage and Processing of Photos
We expressly point out that uploaded photos and videos are processed and stored by us. Storage is limited to 24 hours from the time of capture, after which the file and its entire database record are automatically and permanently deleted (see Section 5). Until then, photos and videos, along with any note attached to them, are accessible to anyone who has the corresponding check code. By using the service, you consent to this processing and storage.
5. Data Storage & Retention
The approximate location (accuracy approx. 10 km), the capture time, the SHA-256 hash, and the check code of the original photo or video are stored in our server database — not on a blockchain. This data, together with the photo or video itself, is automatically and permanently deleted 24 hours after capture. The original photo or video cannot be reconstructed from the SHA-256 hash with current technology. Only the approximate location is stored, never the exact position.
6. Deletion of Photos and Videos
Photos and videos, along with all associated data (see Section 5), are automatically and permanently deleted 24 hours after the time of capture. Anyone may also request deletion of a specific photo or video earlier by contacting us and providing the check code together with a reason for the request; we review each request and delete the record where appropriate.
7. Prohibited Content
It is prohibited to upload, publish, or distribute photos or videos containing criminal material through the service. This also applies to violations of the German Art Copyright Act (Kunsturheberrechtsgesetz, KUG). In particular, publishing photos or videos of persons without their consent may be punishable by law. Users are solely responsible for the content they upload.
8. Availability
Access to photos may be disrupted by maintenance work. The availability of the web application cannot always be guaranteed. TrustCamera assumes no liability for temporary or permanent unavailability of the service.
9. Changes to Terms
TrustCamera reserves the right to modify these Terms of Service at any time. The current version is always available on this page. Continued use of the service after changes constitutes acceptance of the updated terms.
10. Governing Law
These Terms of Service are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Kaiserslautern, Germany, to the extent permitted by law.
